Custom EULA — Effective Upon Acceptance
Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your prior acceptance of this Custom End User License Agreement ("Custom EULA" or "Agreement") between you and the Application Provider. Your license to this Third-Party App under this Agreement is granted by the Application Provider, BlockWatch LLC, and not by Apple.
The Application Provider ("Licensor") reserves all rights in and to the Licensed Application not expressly granted to you under this Agreement. This document represents the Custom EULA between you and BlockWatch LLC ("Application Provider") for the use of the BlockWatch application ("Application"). By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree, do not download or use the Application.
BlockWatch LLC grants to you a nontransferable, non-exclusive license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules outlined in the Apple Media Services Terms and Conditions. The terms of this Agreement will govern any content, materials, or services accessible from or purchased within the Licensed Application. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application.
You agree that Licensor may collect and use technical data and related information — including but not limited to technical information about your device, system, and application software — that is gathered periodically to facilitate software updates, product support, and other services.
To provide its core features, BlockWatch requires you to create an account and collects the following personal information:
Location data is essential to the core functionality of the Application. The Application may collect location data even when the Application is running in the background, depending on your device permissions. You may limit or revoke location access at any time through your device settings, though this may limit Application functionality.
By using the Licensed Application, you agree to the collection and use of this data as outlined in our Privacy Policy, available at: https://www.blockwatch.org/privacy-policy/
The Application allows users to create and share neighborhood reports and other content ("User Content"). By submitting User Content, you agree to the following:
License to BlockWatch: You grant BlockWatch LLC a worldwide, non-exclusive, royalty-free license to host, display, distribute, and moderate your User Content as necessary to operate and improve the Application.
Your Responsibility: You are solely responsible for all User Content you submit. You represent and warrant that your User Content:
BlockWatch's Right to Moderate: BlockWatch LLC reserves the right, but is not obligated, to review, moderate, edit, or remove any User Content at its sole discretion and without notice, including content that violates this Agreement or applicable law.
No Endorsement: BlockWatch LLC does not endorse or verify the accuracy of any User Content. Neighborhood reports reflect the views of individual users only and should not be treated as verified or official crime reports.
You agree not to use the Application to:
Violation of this section may result in immediate termination of your account and access to the Application, and may be reported to law enforcement where appropriate.
The Licensed Application enables access to Licensor's and/or third-party services and websites, requiring Internet access. The Licensed Application integrates with third-party APIs and services, including but not limited to the CrimeoMeter API, Google Places API, and Google Maps.
You agree that BlockWatch LLC is not responsible for examining or evaluating the content or accuracy of these third-party services and APIs. BlockWatch LLC does not warrant and will not have any liability or responsibility for any third-party materials, products, or services. You agree that you will not use any Third-Party Materials in a manner that would infringe or violate the rights of any other party. You must comply with applicable third-party terms of agreement when using the Licensed Application (e.g., your wireless data service agreement).
BlockWatch includes subscriptions and/or in-app purchases. Your payment will be charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
The Application is intended for users who are 13 years of age or older. By using the Application, you represent and warrant that you are at least 13 years of age. If you are under the age of 18, you represent that you have obtained parental or guardian consent to use the Application.
BlockWatch LLC does not knowingly collect personal information from children under the age of 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information promptly.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
BLOCKWATCH IS STRICTLY A NEIGHBOR-TO-NEIGHBOR COMMUNICATION PLATFORM. IT IS NOT A CRIME-REPORTING TOOL, EMERGENCY DISPATCH APPLICATION, OR A SUBSTITUTE FOR CONTACTING LOCAL LAW ENFORCEMENT OR EMERGENCY SERVICES (911). ALL DATA, MAPS, NOTIFICATIONS, AND ALERTS PROVIDED BY BLOCKWATCH (INCLUDING THOSE SOURCED FROM THE CRIMEOMETER API, GOOGLE PLACES API, AND GOOGLE MAPS) ARE STRICTLY FOR INFORMATIONAL AND SITUATIONAL COMMUNICATION PURPOSES AMONG NEIGHBORS. BLOCKWATCH LLC MAKES NO GUARANTEES REGARDING THE ACCURACY, REAL-TIME DELIVERY, OR RELIABILITY OF ANY DATA, NOTIFICATIONS, OR ALERTS.
IN THE EVENT OF AN ACTIVE CRIME, MEDICAL EMERGENCY, OR IMMEDIATE SAFETY THREAT, USERS MUST CONTACT LOCAL EMERGENCY SERVICES DIRECTLY BY DIALING 911 OR THE APPLICABLE EMERGENCY NUMBER IN YOUR JURISDICTION.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE).
This Agreement shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement or your use of the Application shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in a court of law.
YOU AND BLOCKWATCH LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
This Agreement is effective until terminated by you or Licensor. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. BlockWatch LLC reserves the right to suspend or terminate your account and access to the Application at any time, with or without cause, and with or without notice.
You acknowledge and agree that this Agreement is concluded between you and BlockWatch LLC only, and not with Apple. Apple Inc. is not a party to this Custom EULA and has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. BlockWatch LLC, not Apple, is solely responsible for addressing any claims relating to the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to applicable legal or regulatory requirements; and (iii) intellectual property infringement claims.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You and the End-User acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Custom EULA, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Custom EULA against you as a third-party beneficiary thereof.
BlockWatch LLC reserves the right to update or modify this Agreement at any time. We will notify users of material changes through the Application or via email. Your continued use of the Application after any such changes constitutes your acceptance of the new terms.
